Website Terms of Use (New Zealand)
These terms govern the use of the New Zealand version of lodgeyard.com, including its guides, its technical pages, the quote request form and the chat window with its automated replies. The sale of a granny flat is governed separately by our Terms of Sale and your written Quote.
Version 1.0, 25 October 2026.
The chat window on our pages connects you with an automated sales agent, an artificial intelligence system and not a person. It gives general information and cannot make any commitment on our behalf: only a written Quote, signed in accordance with our Terms of Sale, does that.
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
1. About these terms
1.1 These Website Terms of Use (the Terms of Use) apply to every use of the New Zealand version of the Website, including the chat window displayed on its pages and the quote request form.
1.2 By using the Website, you agree to these Terms of Use. If you do not agree to them, please do not use the Website.
1.3 These Terms of Use do not govern the sale of a Unit. A sale is made only on a written, dated Quote, and is governed by the Quote and our Terms of Sale. If these Terms of Use and the Terms of Sale are inconsistent, the Terms of Sale prevail.
1.4 Our Privacy policy and our Cookie policy explain how we handle personal information and which cookies and browser storage the Website uses.
2. Definitions and interpretation
2.1 In these Terms of Use:
- (a) Website means the website at lodgeyard.com, including its New Zealand version, its pages, documents and media;
- (b) automated sales agent means the automated system that answers in the chat window displayed on the Website;
- (c) Content means the texts, guides, technical pages, drawings, photographs, videos, computer-generated images, logos, page layouts and other material on the Website;
- (d) Quote and Unit have the meanings given in our Terms of Sale;
- (e) we, us and our mean REXOR GROUP LLC, Lodgeyard being a brand of REXOR GROUP LLC, and you means any person who uses the Website.
2.2 Headings are for convenience only. The words including and for example do not limit what precedes them. A reference to a statute includes that statute as amended or replaced. If a provision is ambiguous, it is interpreted in the way that is more favourable to you.
3. Who we are
3.1 The Website is operated by REXOR GROUP LLC, a limited liability company registered in New Mexico, USA, 8206 Louisiana Blvd NE, Ste A #9493, Albuquerque, NM 87113, USA, email contact@lodgeyard.com. Lodgeyard is a brand of REXOR GROUP LLC.
3.2 Our full company information is on our Company information page.
4. Information on the Website
4.1 Nothing on the Website is an offer to sell at a fixed price. Prices shown on the Website are indicative prices for a described standard case. The price for your project is the price in your Quote.
4.2 Our guides and technical pages give general information, based on official sources read at the date shown on each page. They do not replace advice from your designer, your council or a lawyer. Rules change: check the current version before you commit.
4.3 Photographs and videos of units show units of the same model that the manufacturer built for other customers. Some visuals on product pages are enhanced with AI from manufacturer's photos. The Unit you buy is the Unit described in your Quote and its drawings.
4.4 The technical pack and the technical pages for designers and builders give the data of the Unit as at the date shown. Every figure is confirmed in the drawings and the written Quote for each project.
4.5 The Website has versions for several countries. Information on the version for another country, for example Australia, relates to the rules, prices and terms of that country and does not apply to a project in New Zealand. If you have chosen another country in the menu, you can return to the New Zealand version at any time.
4.6 Each guide shows the date on which it was last updated. Where a guide refers to an Act, a regulation, a council fee or official guidance, it describes it as at that date.
4.7 We take care to make the Content accurate. Clauses 4.1 to 4.6 describe the nature of the Content; they do not limit our responsibility under the Fair Trading Act 1986 for any representation we make in trade.
5. The chat window
Nature of the service
5.1 The chat window on our pages connects you with Isla, our artificial advisor: an artificial intelligence system, not a person. The window says so when it opens.
5.2 The automated sales agent gives general information about our units, the process and the rules that apply to a granny flat in New Zealand. Like any automated system, it can make mistakes. Before you rely on an answer to make a decision, check it in your Quote, in our written documents or with your designer.
5.3 The automated sales agent cannot accept an order, agree a price, grant a discount, vary our Terms of Sale or make any other commitment on our behalf. Only a written Quote, signed in accordance with our Terms of Sale, or a variation agreed in writing, does that.
5.4 If you ask to speak with a person or leave your contact details, the Lodgeyard team receives them with a transcript of the conversation and replies to you.
5.5 Clauses 5.2 and 5.3 do not limit our responsibility under the Fair Trading Act 1986 for representations made in trade, including through the chat window.
Your use of the chat window
5.6 When you use the chat window, you agree not to:
- (a) send bank, card or password details, health information, or information about other people that they have not agreed to share;
- (b) send content that is unlawful, threatening, abusive, defamatory or discriminatory;
- (c) try to make the automated sales agent produce content unrelated to our business, harmful content or content that misrepresents what we offer;
- (d) try to obtain the instructions, configuration or technical details of the automated sales agent, or to bypass its safeguards;
- (e) use automated means to send messages, or send a volume of messages that is unreasonable for a person enquiring about a project.
5.7 To limit abuse, we keep an encrypted fingerprint of the IP address used in a conversation, and we may end a conversation or limit access to the chat window where clause 5.6 is not complied with.
5.8 The chat window may be unavailable from time to time. You can always write to us at contact@lodgeyard.com instead.
5.9 How we handle conversations, and how long we keep them, is explained in our Privacy policy.
6. The quote request form
6.1 The quote request form lets you ask us to look at your project. Sending it is not an order and does not commit you or us to anything.
6.2 Please give accurate information. We use it to assess your project and reply to you, as described in our Privacy policy.
6.3 We reply by email to the address you give. If you have not heard from us, check your spam folder or write to contact@lodgeyard.com.
6.4 To limit abuse of the form, our host counts submissions per IP address for one minute; the address is not kept. Submissions that exceed that limit may be refused.
7. Acceptable use
7.1 You may use the Website only for lawful purposes and in accordance with these Terms of Use.
7.2 You agree not to:
- (a) use the Website in a way that breaches any law, or that infringes the rights of any person;
- (b) send false information, or impersonate any person, through the form, the chat window or by email;
- (c) attempt to gain unauthorised access to the Website, its servers, the chat window or any connected system, or test their vulnerability without our written permission;
- (d) introduce viruses, malicious code or any material designed to disrupt the Website;
- (e) interfere with the operation of the Website, including by sending a volume of requests that places an unreasonable load on it;
- (f) copy or extract the Content by automated means, except for indexing by search engines in accordance with the instructions published by the Website;
- (g) use the Website, or the contact details on it, to send unsolicited commercial electronic messages.
8. Intellectual property
8.1 The Content is owned by REXOR GROUP LLC or used with the permission of its owners, including the manufacturer and the photographers who license their photographs.
8.2 You may view, download and print pages of the Website for your own use, including to discuss a project with your family, your designer, your builder, your council or your lender.
8.3 If you are a designer, architect, builder or building consultant, you may also use the technical information on the Website to assess and advise on a project involving a Lodgeyard unit.
8.4 Any other reproduction, adaptation, distribution or commercial use of the Content requires our written permission, except as permitted by the Copyright Act 1994. In particular, you may not use the Content to present another supplier's product as ours, or ours as another supplier's.
8.5 The name Lodgeyard and our logo may not be used in a way that suggests a connection with us or our endorsement without our written permission.
9. Content you send us
9.1 When you send us plans, photographs, documents or other material about your project, through the form, the chat window or by email, you allow us to use, copy and share them to the extent needed to assess and carry out your project, as described in our Privacy policy.
9.2 Please send us only material that you are entitled to share. You keep any rights you have in it.
10. Links to and from the Website
10.1 The Website contains links to other websites, such as public bodies, councils and public registers. We do not control them and are not responsible for their content, their availability or their handling of personal information. A link does not mean that we endorse the other website, or that it endorses us.
10.2 You may link to a page of the Website, provided that the link is fair and lawful and does not suggest any association with us or endorsement by us that does not exist.
11. Security and fraud prevention
11.1 We will never ask you to pay to bank details sent by any means other than our pro forma invoice. If in doubt, contact us before paying.
11.2 The automated sales agent never asks for bank, card or password details. If you receive a message that claims to come from us and asks for such details, do not reply to it and tell us at contact@lodgeyard.com.
11.3 If you discover a security weakness in the Website, please tell us at contact@lodgeyard.com and do not exploit it.
12. Availability and changes to the Website
12.1 We provide access to the Website free of charge. We aim to keep it available, but we do not promise that it will be available at all times or free of errors. We may need to suspend it for maintenance, security or reasons beyond our control.
12.2 When you open the Website without having chosen a country, we may send you to the version of the Website for the country of your connection, as described in our Cookie policy. You can choose another country or language in the menu.
12.3 We may change, add or remove Content, features, prices shown and the chat window at any time. A change to the Website does not change a Quote already issued to you or a Contract already formed.
13. Liability
13.1 Nothing in these Terms of Use excludes or limits:
- (a) any right you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, which cannot be excluded by contract for a consumer;
- (b) our liability for fraud or wilful misconduct;
- (c) any other liability that cannot be excluded or limited by law;
- (d) any right you have under a Quote, our Terms of Sale or our written warranty against defects.
13.2 Subject to clause 13.1, and to the extent permitted by law, we are not liable for any loss arising from:
- (a) the unavailability of the Website or the chat window;
- (b) the content of a linked website that we do not control;
- (c) a decision you make on the basis of general information on the Website or in the chat window without checking it in your Quote, in our written documents or with your designer, where that information was given in good faith and you were told to check it;
- (d) loss that was not reasonably foreseeable.
13.3 The Website is provided free of charge. Your rights in relation to a Unit arise from your Quote, our Terms of Sale, our written warranty against defects and the law, not from these Terms of Use.
14. Suspension of access
14.1 If you do not comply with clause 5.6 or clause 7, we may suspend or restrict your access to the Website, the form or the chat window, to the extent reasonably necessary to protect the Website, our other users or us.
14.2 Suspension under this clause does not affect a Quote already issued to you, a Contract already formed or any right you have under the law.
15. Privacy and cookies
15.1 We handle personal information in accordance with the Privacy Act 2020 and our Privacy policy. Our Cookie policy lists the cookies and browser storage used by the Website and the chat window.
15.2 This website uses no analytics or advertising cookies.
16. Changes to these terms
16.1 We may update these Terms of Use. We publish each new version on this page with its version number and date. The version in force when you use the Website applies to that use.
16.2 A change to these Terms of Use does not affect a Quote already issued or a Contract already formed.
17. Governing law and jurisdiction
17.1 These Terms of Use are governed by New Zealand law.
17.2 The courts of New Zealand and the Disputes Tribunal of New Zealand have jurisdiction over any dispute arising out of the use of the Website. You may bring proceedings against us in New Zealand.
18. General provisions
18.1 If a provision of these Terms of Use is invalid or unenforceable, it is severed to the extent necessary, and the rest of these Terms of Use continues to apply.
18.2 A failure or delay by us in enforcing a provision does not waive it.
18.3 These Terms of Use, together with the documents they refer to, are the whole of the terms on which you may use the Website. They do not limit any representation we make in trade or your rights under the Fair Trading Act 1986.
