Written Warranty Against Defects (New Zealand)
Lodgeyard gives you a written warranty against defects in the unit, backed by our manufacturer's warranty. This page sets out its terms. The warranty document comes with your Quote and identifies your Unit.
Version 1.0, 25 October 2026.
This warranty is in addition to your rights under the Consumer Guarantees Act 1993 and does not limit them. It is also in addition to the implied warranties for residential building work in sections 362I to 362Q of the Building Act 2004 and to your rights under the Fair Trading Act 1986.
1. The warrantor
- Warrantor: Lodgeyard, a brand of REXOR GROUP LLC, 8206 Louisiana Blvd NE, Ste A #9493, Albuquerque, NM 87113, USA. Email: contact@lodgeyard.com. Telephone: +63 976 427 9188.
1.1 The warrantor is REXOR GROUP LLC, which supplies the Unit to you under your Quote. Lodgeyard is a brand of REXOR GROUP LLC and not a separate company.
1.2 This warranty is backed by our manufacturer's warranty. You claim against us, not against the manufacturer: we deal with the manufacturer ourselves.
2. Definitions
2.1 In this warranty:
- (a) Unit means the factory-built granny flat identified in your Quote, including the components supplied with it;
- (b) Defect means a defect in the Unit, or in one of its components, including a defect in materials or workmanship;
- (c) Delivery means the delivery of the Unit to your section, and the delivery date is the date on which it takes place;
- (d) Warranty Period means the period set out in clause 4 for the part of the Unit concerned;
- (e) Site Works means the design for your section, the foundations, the fixing of the Unit and its connections, and the other work carried out by the designer, Licensed Building Practitioner and licensed trades named in your Quote;
- (f) Quote means the written Quote under which the Unit is supplied to you, and you means the client named in it;
- (g) we, us and our mean the warrantor.
3. What this warranty covers
3.1 We warrant the Unit against Defects that you tell us about within the Warranty Period that applies to the part of the Unit concerned.
3.2 This warranty covers the Unit supplied by us. It does not cover the Site Works, which are dealt with in clause 8.
3.3 This warranty is given free of charge, as part of the supply of the Unit. It is not an extended warranty for which you pay a separate price.
4. Warranty periods
4.1 The periods are counted from delivery of the Unit to your section:
| Part of the Unit | Warranty Period |
|---|---|
| The whole Unit (materials and workmanship) | 12 months |
| The steel frame, with the PVDF coating option | 10 years |
| The roof and wall panels | 5 years |
| Windows, doors, electrical and plumbing components | 2 years |
4.2 The periods run concurrently. A Defect in a part that has a longer Warranty Period remains covered until the end of that longer period, even after the 12-month period for the whole Unit has ended.
4.3 The steel frame is in any case covered as part of the whole Unit for the first 12 months. The 10-year period applies where your Quote includes the PVDF coating option.
5. How to make a claim
5.1 Tell us of the Defect in writing within its Warranty Period, by email to contact@lodgeyard.com, with:
- (a) your Quote number;
- (b) a short description of the Defect;
- (c) photos.
5.2 Give us or our repairer reasonable access to the Unit, at a time agreed with you, so that the Defect can be assessed and remedied.
5.3 If the Defect is getting worse, or could cause damage, please tell us as soon as you notice it and take any reasonable step that is safe for you to limit the damage, for example by turning off the water supply to a leaking fitting.
5.4 A claim made by email within the Warranty Period is in time even if the assessment or the repair takes place after the end of that period.
5.5 When we receive your claim, we assess it on the basis of your description and photos and, where needed, an inspection of the Unit by us or our repairer. We then tell you in writing how and when the Defect will be remedied.
5.6 Please keep your Quote and the warranty document issued with it. They identify your Unit and help us deal with your claim quickly.
5.7 The same email may also be used to give notice of a defect under section 362Q of the Building Act 2004 or to require us to remedy a failure under the Consumer Guarantees Act 1993.
6. What we do
6.1 We repair or replace the defective part, or have it repaired or replaced, within a reasonable time.
6.2 We may carry out the repair or replacement ourselves or through a repairer we appoint. We remain responsible to you for the work.
6.3 A part that is repaired or replaced under this warranty remains covered for the rest of the Warranty Period that applied to it.
6.4 If we do not remedy a Defect within a reasonable time, you keep every right you have under the Consumer Guarantees Act 1993 and the Building Act 2004, including the right to have the failure remedied elsewhere and recover the reasonable costs from us where those Acts give that right.
7. Costs
7.1 We bear the cost of a valid claim, including parts, labour and transport.
7.2 If you pay an expense to make a claim, send us the receipt with your claim and we refund it.
7.3 You do not pay any fee to make a claim under this warranty.
8. What is not covered
8.1 This warranty does not cover:
- (a) the Site Works, which the LBP and trades named in your Quote warrant under the Building Act 2004;
- (b) damage caused by misuse, lack of normal maintenance or alterations made without our agreement.
8.2 Clause 8.1 limits this written warranty only. It does not limit your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or the Building Act 2004.
8.3 If we consider that a claim falls within clause 8.1, we tell you in writing and explain why. Where the cause of a Defect is disputed, clause 12 applies.
9. Your other rights
9.1 The benefits given to you by this warranty are in addition to your other rights and remedies under New Zealand law. In particular:
- (a) where you acquire the Unit as a consumer, the Consumer Guarantees Act 1993 gives you guarantees that cannot be excluded, including that the Unit is of acceptable quality, fit for any particular purpose you make known to us and matches its description. If the Unit fails to meet a guarantee and the failure can be fixed, we must fix it within a reasonable time. If the failure is substantial or cannot be fixed, you can reject the Unit or ask for a price reduction. You can also claim for any other reasonably foreseeable loss;
- (b) the Building Act 2004 implies warranties into residential building work (section 362I), and a defect notified within 12 months of completion must be remedied (section 362Q): for the Unit, by us; for the Site Works, by the LBP and trades named in your Quote;
- (c) the Fair Trading Act 1986 protects you against misleading conduct and false or misleading representations, including about your rights under the Consumer Guarantees Act 1993.
9.2 You choose whether to make a claim under this warranty, under the Consumer Guarantees Act 1993, under the Building Act 2004 or under several of them at once.
10. Maintenance
10.1 Any maintenance information we give you for the Unit, including the information we provide under section 362T of the Building Act 2004 where that section applies, describes its normal maintenance. Normal maintenance keeps the Unit in good condition and preserves the cover of this warranty.
10.2 If you are unsure whether a task is part of normal maintenance, or whether an alteration needs our agreement, ask us at contact@lodgeyard.com before you carry it out. We reply in writing.
11. Later owners
11.1 This warranty is given to the client named in the Quote. Whether it passes to a later owner of your section is stated in the warranty document issued with your Quote.
11.2 Independently of this warranty, a later owner may take proceedings for a breach of the implied warranties under section 362J of the Building Act 2004.
12. Disputes
12.1 If you disagree with our response to a claim, write to us at contact@lodgeyard.com. The complaint and dispute resolution process in clause 27 of our Terms of Sale applies.
12.2 You may also bring a claim before the Disputes Tribunal of New Zealand or a New Zealand court, without first going through that process.
13. Governing law and relationship with other documents
13.1 This warranty is governed by New Zealand law.
13.2 This warranty forms part of the contract under which the Unit is supplied to you, and is summarised in clause 20 of our Terms of Sale. If the terms of the warranty document issued with your Quote differ from this page, the terms more favourable to you apply.
13.3 We handle the information you send us with a claim, including photos of your home, in accordance with our Privacy policy, and we share it only with the repairer and the manufacturer who need it to deal with the claim.
13.4 Related documents: Terms of Sale, Privacy policy, Company information and the index of legal documents.
