Website terms of use
These terms govern your use of the Australian pages of lodgeyard.com, operated by Lodgeyard, a brand of REXOR GROUP LLC, including the information and prices they show, the chat window and its automated replies, and the quote form. The purchase of a granny flat is governed by our separate terms of sale and your written quote. Nothing in these terms limits your rights under the Australian Consumer Law.
Version 1.0. Effective date: 25 October 2026.
1. About these terms
1.1 These terms of use (Terms of Use) govern your access to and use of the Website. By using the Website, you agree to them. If you do not agree to them, please do not use the Website.
1.2 These Terms of Use do not govern the purchase of a Unit. Each sale is made on a written Quote, and is governed by that Quote and by our Terms of sale. If these Terms of Use are inconsistent with your Quote or our Terms of sale, the Quote and the Terms of sale prevail.
1.3 Nothing in these Terms of Use excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. If a provision of these Terms of Use would have that effect, it does not apply to that extent.
2. Definitions
2.1 In these Terms of Use:
- ACL means the Australian Consumer Law set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth);
- automated sales agent means the automated system that you can write to in the chat window of the Website;
- Content means all text, photographs, images, videos, drawings, guides, data, software, design and other material on the Website;
- Quote means our written quote for a Unit;
- Unit means a factory-built expandable granny flat offered by us;
- Website means the Australian pages of lodgeyard.com, including the chat window and the quote form displayed on them;
- we, us, our and Lodgeyard mean REXOR GROUP LLC, acting under its brand Lodgeyard;
- you and your mean the person using the Website.
3. Who operates the Website
3.1 The Website is operated by REXOR GROUP LLC, a limited liability company registered in New Mexico, USA, 8206 Louisiana Blvd NE, Ste A #9493, Albuquerque, NM 87113, USA, email contact@lodgeyard.com. Lodgeyard is a brand of REXOR GROUP LLC. Further details are in our Company information.
4. Information on the Website
4.1 We take care to keep the information on the Website accurate and up to date. Each page reflects our offer and our understanding of the rules at the date it was last updated.
4.2 Information on the Website about approvals, building rules, importing, biosecurity, asbestos, plumbing and electrical standards, and the Home Building Act 1989 (NSW) is general information about how these rules apply to our Units. It is not legal, planning, engineering or financial advice about your particular situation. Whether a Unit can be approved on your block is decided by your council or a registered certifier, and the approval pathway for your block is confirmed in writing before you order.
4.3 The Unit you buy is the Unit described in your Quote, its specification and its drawings. Photographs on the Website may show units of the same model built for other customers, and some visuals on product pages are enhanced with AI from manufacturer's photos. Options shown in images are included only if they are listed in your Quote.
4.4 Our guides and pages may refer to laws, standards, fees and prices set by third parties, such as councils, certifiers and government authorities. Those third parties may change them at any time, and the amounts that apply to you are those they set.
4.5 This clause 4 does not limit our responsibility under the ACL for any statement on the Website that is misleading or deceptive. If you think that information on the Website is inaccurate, please tell us, and we will check it and correct it if needed.
5. Prices and quotes
5.1 Nothing on this website is an offer to sell at a fixed price. Prices shown on the Website are starting prices for the Unit described next to them, on the assumptions stated with them, such as a standard block in metro Sydney.
5.2 Where we show a turnkey price, it is a single total that adds up the amounts payable to us and the amounts payable to others, such as the GST and import charges paid at the border, the price of the licensed NSW builder for the site works and the approval fees, as explained next to the price. Each of those parts is set out in your Quote, with who is paid what.
5.3 Each sale is made on a written Quote. A Quote is valid for the period stated in it, and a contract is formed only as described in our Terms of sale. Nothing is payable to us before the Australian version of the Unit is confirmed in writing in your Quote and your council or certifier confirms in writing that your Unit can be approved on your block.
6. The chat window
6.1 The chat window on our pages connects you with an automated sales agent: an artificial intelligence system, not a person. It may be presented under a first name, and the chat window tells you that it is an artificial intelligence system.
6.2 The automated sales agent answers questions about our Units, our process and our prices, and can pass your request to our team. If you ask to speak with a person or leave your contact details, our team receives them with a transcript of the conversation, so that it can reply to you.
6.3 The automated sales agent can make mistakes. Before you rely on what it tells you about price, specification, approvals, delivery, importing or your rights, check it against your written Quote, our Terms of sale or with our team. If anything the automated sales agent tells you is inconsistent with your written Quote, the written Quote applies.
6.4 The automated sales agent cannot make or accept an offer, agree a price, discount or delivery date, give a binding approval or commitment, or change our Terms of sale. Only a written Quote and the documents referred to in our Terms of sale bind us.
6.5 This clause 6 does not limit our responsibility under the ACL for information given in the chat window.
6.6 Never enter bank account details, payment card details, passwords or sensitive information in the chat window. The automated sales agent never asks you for bank or payment card details, and never gives you bank details for a payment.
6.7 When you use the chat window, you must not:
- (a) attempt to make the automated sales agent disclose its instructions, configuration or internal information, or behave in a way it is not designed to behave;
- (b) send content that is unlawful, abusive, threatening, defamatory or obscene, or that infringes the rights of others;
- (c) send automated or repeated messages, or use the chat window for any purpose other than a genuine enquiry about our Units;
- (d) present text as if it had been written by the automated sales agent or by us.
6.8 To protect the service, the number of messages that can be sent from one connection is limited, and we may end a conversation that does not comply with clause 6.7.
6.9 How we handle your conversations, including where they are held and for how long, is described in our Privacy policy.
7. The quote form
7.1 When you use the quote form, you agree to give accurate information about yourself and your project. The more accurate it is, the more useful our reply will be.
7.2 Only use the quote form for a genuine enquiry about a Unit. Do not submit another person's details without their agreement.
7.3 To limit abuse of the form, our host counts submissions per IP address for one minute; the address is not kept. Submissions beyond the limit may be refused, and you can try again a little later or write to us by email.
7.4 Sending the quote form does not create any obligation for you or for us. We reply to you, and any sale is made on a written Quote.
8. Acceptable use
8.1 You may use the Website only for lawful purposes and in accordance with these Terms of Use. You must not:
- (a) use the Website in a way that breaches any law, or the rights of any person;
- (b) attempt to gain unauthorised access to the Website, its servers, its forms, the chat window or any system connected to them, or attempt to bypass any security or rate limit;
- (c) introduce viruses, malicious code or any material that is technologically harmful;
- (d) interfere with or disrupt the Website, for example by sending excessive requests;
- (e) copy, extract or reuse the Content systematically, including by automated means, other than through the ordinary operation of a search engine;
- (f) impersonate us or any other person, or misrepresent your connection with us;
- (g) use the Website or its Content to send unsolicited commercial messages;
- (h) frame, mirror or reproduce the Website or any part of it on another website without our written permission.
8.2 You may link to the home page or any public page of the Website, provided that you do so fairly and lawfully, and that you do not suggest any association, approval or endorsement on our part that does not exist.
9. Intellectual property
9.1 The Content is owned by REXOR GROUP LLC or used under licence from its owners, including the manufacturers of our Units and the photographers and libraries that supplied photographs. It is protected by the Copyright Act 1968 (Cth) and by the laws of other countries.
9.2 You may view the Website, and print or download extracts of it, for your own personal and non-commercial use, including to discuss your project with your family, your builder, your certifier or your council. You must keep any copyright or other notices on what you print or download.
9.3 You must not otherwise reproduce, publish, adapt, distribute or commercially use the Content without our written permission, except as permitted by law.
9.4 Lodgeyard, our logo and the names of our models are used by REXOR GROUP LLC as trade marks. You must not use them without our written permission, other than to refer accurately to us or to our Units.
9.5 The photographs of our Units show units of the same model that our manufacturer built for customers in Australia, used with its written permission. Credits for third-party photographs are given in our Company information.
10. What you send us
10.1 You keep the rights in the messages, photographs, plans and other material you send us through the Website or by email.
10.2 You give us permission to use that material to reply to you, to assess your project, to prepare a Quote and, if you order, to perform our contract with you, including by sharing it with the people described in our Privacy policy.
10.3 You must only send us material that you are entitled to send. For example, if you send us plans prepared by someone else, make sure you are entitled to share them for your project.
10.4 We handle personal information in the material you send us in accordance with our Privacy policy.
11. Links to other websites
11.1 The Website contains links to other websites, such as those of government authorities and regulators, for your information. We do not control those websites and are not responsible for their content, their availability or the way they handle personal information.
11.2 A link does not mean that we endorse the website concerned or its operator, or that they endorse us.
12. Availability and changes to the Website
12.1 We aim to keep the Website available, but we do not guarantee that it, the chat window or the quote form will always be available or free of errors. We may suspend them for maintenance, for security or for reasons beyond our control.
12.2 We may change, update or remove any part of the Website, including the models and prices shown, at any time. A change to the Website does not change a Quote we have issued or a contract we have entered into.
12.3 If the chat window or the quote form is unavailable, you can always write to us at contact@lodgeyard.com.
13. Security and payment fraud
13.1 Payments to us are made by bank transfer to the account shown on our pro forma invoice. We will never ask you to pay to bank details sent by any other means. If in doubt, contact us before paying.
13.2 Be cautious of websites, emails or messages that imitate Lodgeyard. The Lodgeyard website is lodgeyard.com, and we write to customers from addresses ending in @lodgeyard.com. If you receive a suspicious message, do not click its links or pay, and tell us.
13.3 If you discover a security vulnerability in the Website, please tell us at contact@lodgeyard.com, give us a reasonable opportunity to fix it before disclosing it, and do not access, modify or delete data that is not yours.
14. Liability
14.1 Nothing in these Terms of Use excludes, restricts or modifies any consumer guarantee or other right or remedy you have under the ACL, or our liability for death or personal injury, or for fraud.
14.2 We are responsible for loss or damage you suffer that is a reasonably foreseeable result of our failure to comply with these Terms of Use or of our negligence in operating the Website.
14.3 Subject to clauses 14.1 and 14.2, we are not responsible for loss or damage to the extent that it is caused by:
- (a) events beyond our reasonable control, such as a failure of the internet, of telecommunications networks or of your equipment;
- (b) your use of the Website in breach of these Terms of Use;
- (c) the content of other websites linked from the Website.
14.4 Our responsibility for the Units we sell, and your rights in relation to them, are set out in our Terms of sale and in our Warranty against defects, and are not limited by these Terms of Use.
14.5 If you breach these Terms of Use and that causes us loss, you are responsible for that loss to the extent the law provides.
15. Suspension of access
15.1 If you use the Website, the chat window or the quote form in breach of clause 6.7 or clause 8, we may limit or block access from the connection or device concerned, to the extent reasonably necessary to protect the Website and its users.
15.2 Blocking access to the Website does not affect any Quote we have issued to you or any contract between us. You can always contact us by email.
16. Privacy and cookies
16.1 We handle personal information in accordance with our Privacy policy.
16.2 This website uses no analytics or advertising cookies. The cookies and browser storage used on the Website are described in our Cookie policy.
17. General provisions
17.1 If a provision of these Terms of Use is void or unenforceable, it is severed to that extent, and the rest of these Terms of Use continues to apply.
17.2 A failure or delay in enforcing a provision of these Terms of Use does not waive it.
17.3 Where these Terms of Use are unclear, the general law of interpretation applies, including the rule that an ambiguous term is read against the party that drafted it.
17.4 The Website is intended for people in Australia. Information about our offer in other countries is published on the version of the Website for those countries.
18. Governing law and jurisdiction
18.1 These Terms of Use are governed by the law of New South Wales. Nothing in them limits your rights under the Australian Consumer Law.
18.2 The courts and tribunals of New South Wales, and the federal courts sitting in New South Wales, have non-exclusive jurisdiction over disputes about these Terms of Use. Nothing in this clause prevents you from bringing a claim in any other court or tribunal that has jurisdiction.
19. Changes to these terms
19.1 We may update these Terms of Use from time to time. Each version is published on the Website with its version number and effective date, and applies to your use of the Website from that date.
19.2 A change to these Terms of Use does not change a Quote we have issued or a contract we have entered into, which remain governed by the documents that applied when they were made.
